Everything about activities in space is based on US Law (for Americans) and the 1967 Outer Space Treaty (which all major space powers adhere to). The '67 OST sets up a regime much like deep sea fishing. You can go where you want, mine what you want, and keep what you mine, but you can't interfere in anyone else's operations, and if you abandon your "claim" you have no rights to it (so it isn't a claim at all, just an area of operations). The proposed Asteroid Act is an attempt to implement this in US law; Dean Larson of the Planetary Society went over the basics fairly well in his WSJ Op Ed.
